Terms of Service

1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") govern the provision of garden and landscape services by Maple Leaf Garden & Landscape Co. ("Company," "we," "us," or "our") to any customer, client, or website user ("you" or "Customer"). By requesting, scheduling, paying for, or accepting any services from Maple Leaf Garden & Landscape Co., you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services or website. These Terms apply in addition to any written estimate, proposal, work order, invoice, service agreement, or other document issued by Maple Leaf Garden & Landscape Co. If there is a conflict between these Terms and a signed written agreement, the signed written agreement will prevail to the extent of the conflict.
2. Scope of Services
Maple Leaf Garden & Landscape Co. provides residential and commercial garden and landscape services, which may include, without limitation:
- Garden design and planting;
- Lawn care and edging;
- Seasonal cleanups;
- Mulching and soil improvement;
- Shrub and hedge trimming; and
- Weed control and bed maintenance.
Service details, timing, materials, and pricing may vary depending on site conditions, weather, seasonality, plant availability, and the scope agreed upon in a quotation or work order. Any services not expressly included in a written estimate or work order are excluded unless separately approved in writing by both parties.
We may refuse, suspend, or modify services where site conditions are unsafe, access is restricted, required permits are unavailable, or the requested work would violate applicable law, bylaws, environmental restrictions, or property rules.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate, complete, and current information when requesting services;
- Ensure that you have the legal right to authorize work at the property;
- Obtain any required permissions from landlords, strata corporations, municipalities, or other third parties;
- Clearly identify underground utilities, irrigation systems, septic components, hidden hazards, fragile structures, and other known risks before work begins;
- Remove or secure valuables, pets, children, furniture, vehicles, and other items that may interfere with or be damaged by the services;
- Provide safe and reasonable access to the property, water, electricity, and disposal areas if required for the work;
- Comply with all applicable laws, bylaws, and property rules;
- Promptly notify us of any concerns, defects, or issues after service completion; and
- Pay all amounts due in accordance with the agreed payment terms.
You acknowledge that landscaping and garden work may involve living materials, soil conditions, weather exposure, and seasonal variability. Results may differ based on environmental factors outside our control.
4. Payment Terms and Conditions
Unless otherwise stated in a written estimate or invoice, all fees are due upon completion of the services. For larger projects, recurring services, or custom work, Maple Leaf Garden & Landscape Co. may require a deposit, progress payments, or prepayment before work begins.
All prices are quoted in Canadian dollars (CAD) unless otherwise stated. Applicable taxes, including GST/HST/PST where required by law, will be added to invoices as applicable.
If payment is not received by the due date, we may charge interest at the maximum lawful rate or, if no rate is specified, at 2% per month compounded monthly, subject to applicable law. You are responsible for all reasonable costs of collection, including legal fees and collection agency fees, to the extent permitted by law.
We reserve the right to suspend future services, withhold deliverables, or cancel scheduled work if any invoice remains unpaid.
Any change orders, additional labor, extra materials, disposal fees, emergency call-outs, or work arising from undisclosed site conditions may be billed separately.
5. Cancellation and Refund Policy
You may cancel a scheduled service by providing reasonable notice. Unless otherwise stated in a written agreement:
- Cancellations made at least 48 hours before the scheduled service may not incur a cancellation fee;
- Cancellations made less than 48 hours before the scheduled service may be subject to a cancellation fee to cover administrative costs, reserved labor, and materials;
- If materials have already been ordered, prepared, or delivered, those costs are non-refundable;
- If work has already commenced, you will be charged for all services performed, labor time, and materials used up to the date of cancellation.
Refunds, if any, are issued at our discretion and only where required by law or expressly agreed in writing. Because garden and landscape services are affected by weather, plant health, soil conditions, and site-specific factors, we do not guarantee refunds for outcomes influenced by conditions outside our control.
If you believe a service was not performed in accordance with the agreed scope, you must notify us in writing within 7 days of completion so that we may inspect and, where appropriate, remedy the issue. Failure to notify us within this period may affect any claim for adjustment or refund, subject to applicable law.
6. Liability Limitations
To the maximum extent permitted by applicable Canadian law, Maple Leaf Garden & Landscape Co. shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of use, loss of enjoyment, loss of profits, loss of business, or loss of data, arising from or related to our services, even if advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to the services, whether in contract, tort, negligence, strict liability, or otherwise, shall not exceed the total amount paid by you to Maple Leaf Garden & Landscape Co. for the specific service giving rise to the claim, except where such limitation is prohibited by law.
We are not responsible for:
- Pre-existing property damage, hidden defects, or structural issues;
- Damage caused by underground utilities, irrigation systems, buried objects, or undisclosed hazards;
- Plant failure due to weather, pests, disease, improper care, soil conditions, or irrigation issues beyond our control;
- Damage caused by third parties, animals, vandalism, or acts of nature;
- Delays or failures caused by inaccurate information provided by you; or
- Any loss resulting from your failure to follow our care instructions.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, wilful misconduct, or gross negligence where such limitation would be unlawful.
7. Intellectual Property Rights
All content created or provided by Maple Leaf Garden & Landscape Co., including quotations, designs, plans, drawings, photographs, text, branding, and website materials, remains our property or the property of our licensors unless otherwise agreed in writing.
Upon full payment, you receive a limited, non-exclusive, non-transferable license to use any final garden design or plan we provide solely for the property and project for which it was prepared. You may not reproduce, resell, publish, or distribute our materials without prior written consent.
We may photograph completed work for recordkeeping, quality assurance, marketing, and portfolio purposes, provided that any use of personal information is handled in accordance with applicable privacy laws and, where required, with appropriate consent.
8. Data Protection and Privacy
Maple Leaf Garden & Landscape Co. collects, uses, and discloses personal information only as reasonably necessary to provide services, manage customer relationships, process payments, communicate with you, comply with legal obligations, and improve our operations.
We take reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, loss, or misuse. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
By using our services, you consent to the collection, use, and disclosure of your personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation, as applicable.

9. Force Majeure
Maple Leaf Garden & Landscape Co. shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to severe weather, storms, flooding, wildfire, ice, labour disputes, supply shortages, transportation disruptions, power outages, government actions, public health emergencies, or acts of God.
In the event of force majeure, we may reschedule, suspend, or modify services without liability. If a force majeure event continues for an extended period, either party may terminate the affected service by written notice, subject to payment for work already performed and non-cancellable costs incurred.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The updated Terms will be effective upon posting on our website or upon written notice to you, as applicable.
Your continued use of our services after any update constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using our services and, if applicable, notify us before the next scheduled service.
11. Applicable Law and Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to them, the services, or the relationship between you and Maple Leaf Garden & Landscape Co. shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that the courts located in Vancouver, British Columbia shall have exclusive jurisdiction over any dispute arising from or related to these Terms or our services, except where applicable law requires otherwise.

13. Severability Clause
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed or limited to the minimum extent necessary so that the remaining provisions remain in full force and effect. The invalidity or unenforceability of any provision shall not affect the validity of the remaining provisions.
